Facaro. Terms and Conditions:
All Facaro artworks are made to order. Due to the labor intensive nature of designing and building , all orders are final sale and are ineligible for return or refund. A deposit of 100% is required to begin custom work. Unless otherwise specified, the cost of shipping + packaging, UL listing, finish samples, and custom finishes are not included in quoted price and will be calculated and charged separately. Remission of payment constitutes acceptance of all terms and conditions outlined in this document. Facaro recommends that the artwork be professionally installed by a licensed, bonded, and insured electrical contractor. Failure to properly install the artwork and/or abide by the maintenance instructions will result in voiding any warranty.
Returns:
Because of the handmade nature of our artwork, we do not accept returns. All orders are carefully packed and shipped. Contact caro@facaro.com within 5 days of receipt if an item arrives damaged. Photographs of the damage will be required so that a claim can be made with the carrier and a replacement can be sent.
UL Services:
Facaro uses Neptune Glassworks, LLC for all UL testing. The cost of the UL testing is included in the invoice price.
Intellectual Property Rights:
Collector hereby acknowledges and agrees that Carolina Fontoura Alzaga for herself and for Facaro, shall be deemed to be the owner of any intellectual property rights relating to the artworks, images and text which appear on and/or are the subject matter of this website. Collector further agrees not to reverse engineer any artworks appearing on this site. Fontoura Alzaga owns all IP Rights in perpetuity, worldwide, royalty-free and freely assignable from the time of their creation and to the fullest extent permitted by law.
Facaro Limited Warranty:
Facaro warrants all its artwork to be free from defects in material and workmanship, subject to certain conditions and exclusions, for the following time periods from the date the artwork was shipped to the original end use purchaser.
Indoor Lighting sculptures:
Electrical Components: Lifetime
Armature finish: 5 years
Recycled bicycle chain ages with time
What Facaro will do: Facaro will, at its election, repair, replace or make appropriate adjustment where Facaro inspection discloses any such defects occurring in normal usage within the applicable time period above, subject to the following conditions and exclusions.
What is not covered: The following costs, expenses and damages are not covered by the
provisions of this limited warranty: (i) labor costs including, but not limited to, such costs as the removal and re-installation of artwork; (ii) shipping and freight expenses required to return artwork to Facaro.
Original User: All warranties only apply to the original end use purchaser and original installation of artwork. This warranty is not transferable. If the purchaser is purchasing the artwork on behalf of a third party or for the purpose of resale, the warranty will cover the first end-user of the artwork as long as that end-user abides by the installation and maintenance requirements previously set forth in these terms and conditions.
The provisions of this warranty do not apply to artwork: (i) used in commercial applications; (ii) used for purposes for which they are not designed or intended; (iii) which have been subjected to alteration, abuse, misuse, negligence or accident; (iv) which have been improperly stored, installed, maintained or operated; (v) which have been used in violaBon of written instructions provided by Facaro; (vi) which have been subjected to improper temperature, humidity or other environmental conditions; or (vii) which, based on Facaro’s examination, involve a failure to disclose to Facaro’s satisfaction warranty non-conformance. Additionally, this warranty DOES NOT COVER scratches, abrasions, or deterioration due to the use of paints, solvents, chemicals or abrasive cleaning techniques.
The above warranties also do not apply if: The original bill of sale, delivery date, or product number cannot be verified. The parts claimed to be defective are not returned for inspection if so requested by Facaro. The artwork is not in the possession of the original end use purchaser.

Finish Warranty Exclusions:
 All artwork is for indoor use only.
Raw Metal Finishes: Raw metal finishes are subject to change due to prolonged exposure to sunlight, moisture, pollutants and other environmental conditions. Raw metal finishes will naturally mature over time, changing in appearance and creating a living finish. Thus, any claim for fading, discoloration or “patina” of a finish on a raw metal fixture is not covered by the above warranty.
Coastal Environments: The environment within ten miles of a sea coast can be extremely corrosive. Even with appropriate maintenance, artwork installed in this environment will typically deteriorate more than artwork installed in a less salt/humid environment. Some corrosion and/or deterioration is considered “normal wear” in this environment. Thus, any claim for finish failures or for corrosion of other components due to coastal environmental conditions is not covered by the above warranty.
Additional terms:
Facaro’s maximum liability under any circumstances is limited to a maximum of the original
purchase price of the artwork. No action arising out of any claimed breach of this warranty by Facaro may be brought by the Original User more than one (1) year after the cause of action has arisen.
IMPLIED WARRANTIES INCLUDING THAT OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE ARE EXPRESSLY LIMITED IN DURATION TO THE DURATION OF THIS WARRANTY. Facaro AND/OR SELLER DISCLAIMS ANY LIABILITY FOR SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES.
